Terms and Conditions

1. Organization and Mission

Vanamalee is the public-facing initiative of Sakala Prani Samrakshana Inc. The corporation is organized for charitable purposes, including protection and care of animals, birds and living beings; Go Seva; education; health and community well-being; environmental initiatives; responsible research; and disaster relief. Website descriptions do not guarantee that every contemplated activity is currently offered.

2. Permitted Use

You may use the website for lawful personal, charitable and informational purposes. You may not:

• interfere with website operation, security or access;
• attempt unauthorized access to accounts, systems or data;
• submit false, misleading, unlawful, abusive or infringing material;
• impersonate the organization or another person;
• use website content or contact information for spam, fraud or unauthorized commercial solicitation; or
• copy or exploit substantial website content except as permitted by law or written authorization.

3. Donations

Donations are voluntary and support the organization’s approved charitable purposes. Unless the organization expressly accepts a written restriction through an authorized representative, a donation is unrestricted and may be applied where the Board determines it is most needed within those purposes.

Donations generally are final and nonrefundable. We may review a prompt refund request involving a duplicate, mistaken or unauthorized payment, but no refund is guaranteed except where required by law. Contact us immediately and also contact your bank if you believe a transaction was unauthorized.

4. Zelle Payments

The published Zelle recipient email is vanamalee.sps@gmail.com. You are responsible for checking the recipient before sending. Zelle transactions are generally difficult to reverse. Zelle and participating financial institutions are independent providers with separate terms and privacy policies. Their names and marks belong to their respective owners.

5. Tax and Donation Acknowledgments

We do not provide tax advice and do not guarantee that a contribution is deductible. Deductibility depends on applicable law, the organization’s recognized status at the relevant time, the nature of the contribution and the donor’s circumstances. Donors should retain payment records, request an acknowledgment when appropriate and consult a qualified tax adviser. If goods or services are provided in exchange for a payment, only the amount exceeding their fair market value may be deductible, subject to applicable law.

6. Volunteer and Partnership Requests

Submitting a volunteer, grant, rescue, partnership or service request does not create employment, agency, fiduciary, contractual or beneficiary status and does not guarantee acceptance, funding or assistance. Activities require appropriate approval and may be subject to screening, safety rules, supervision and separate written terms.

7. No Emergency Service or Professional Advice

The website is not an emergency service and does not provide medical, veterinary, legal, tax, financial or other professional advice. For urgent situations, contact the appropriate local authority or qualified professional.

8. Intellectual Property

Unless otherwise stated, website text, graphics, layout, logos and original materials are owned by or licensed to Sakala Prani Samrakshana Inc. You may view and share links for personal, noncommercial purposes. Other reproduction, modification, publication, sale or commercial use requires prior written permission. Third-party names and marks remain the property of their owners.

9. User Submissions

You retain ownership of original material you submit. You represent that you have permission to provide it. When you submit material for publication or program use, you grant the organization a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt and display it for the purpose for which it was submitted, subject to applicable privacy law and any written limitations we accept.

10. Third-Party Services and Links

We may link to or use third-party services such as hosting, email, maps, social media, analytics, banking or Zelle. We do not control their services, availability, security, content or policies and are not responsible for them. Use of third-party services is governed by their terms.

11. Website Availability and Changes

We may change, suspend or discontinue website content or features at any time. We do not promise uninterrupted, secure or error-free access. We may correct errors and update these terms by posting a revised effective date.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including warranties of accuracy, fitness for a particular purpose, noninfringement or availability. Applicable law may not permit some exclusions.

13. Limitation of Liability

To the fullest extent permitted by law, Sakala Prani Samrakshana Inc. and its directors, officers, volunteers and authorized representatives will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from website use, reliance on content, third-party services or inability to access the website. Nothing in these terms limits liability that cannot lawfully be limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Sakala Prani Samrakshana Inc. and its directors, officers and authorized representatives from claims, losses or expenses arising from your unlawful use of the website, violation of these terms or infringement of another person’s rights.

15. Governing Law and Venue

These terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Subject to any mandatory law that applies, disputes relating to these terms or the website shall be brought in a state or federal court with jurisdiction in Montgomery County, Maryland. Before filing a claim, the parties should attempt in good faith to resolve the matter informally.

16. Severability and No Waiver

If any provision is held unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver.
